Terms of Service

Acceptance

These Terms of Service (“Terms”) govern your use of Kivo (“Kivo”), the multiplayer memory card game available at https://www.kivogame.com and related apps. By creating an account, signing in, or using Kivo, you agree to these Terms and to the Privacy Policy.

Eligibility and accounts

You must be able to form a binding contract under the laws that apply to you to create a Kivo account. Do not create an account for someone else without permission.
You are responsible for your account credentials and for activity under your account. Keep your password confidential. Notify us if you believe your account was compromised.
Each account receives a Kivo Code used for identity and finding players. Display names are chosen by you and are not unique.

The Kivo service

Kivo provides online and Real Life multiplayer memory-card gameplay, profiles, friends features, optional notifications, and related features we may add or change over time.
We do not guarantee uninterrupted availability, matchmaking quality, or that every feature will remain available in its current form. We may modify, suspend, or discontinue parts of the service.

Fair play and acceptable use

Play fairly. Do not cheat, exploit bugs for unfair advantage, automate play in ways that harm other players, harass others, or attempt to disrupt matchmaking, rankings, or servers.
Do not reverse engineer the service except where applicable law allows, scrape private player data, or interfere with security or authoritative game logic.
Ranked and other competitive results are determined by Kivo’s server-authoritative systems. Attempts to manipulate ratings, queues, or outcomes are prohibited.

Profile content

You are responsible for your display name and profile photo. Do not upload illegal, infringing, or abusive content. We may remove content or restrict accounts that violate these Terms.
You grant Kivo a limited license to host and display your profile photo and display name as needed to operate public profiles and gameplay identity.

Real Life guests

Real Life tables may allow guests to join with a temporary identity and a table display name without creating a full Kivo account. Guest access is limited to that table experience and does not create a lasting public profile.

Intellectual property

Kivo, including its name, software, rules presentation, and artwork we provide, is owned by the operator of the service or its licensors. These Terms do not transfer ownership to you. You may use Kivo only as allowed by the service.

Third-party services

Kivo uses third-party infrastructure such as Firebase / Google Cloud, Vercel, Expo, and Google sign-in. Their terms and privacy policies also apply to their processing. Kivo is not affiliated with or endorsed by the owners of Cabo or other third-party card games that players may compare us to.

Termination and account deletion

You may stop using Kivo at any time and may delete your account from Settings. We may suspend or terminate access if you violate these Terms or if we need to protect the service or other players.
Account deletion removes your private account and presents your public profile as deleted. Some shared game history and anonymized ledger records may remain as described in the Privacy Policy.

Disclaimers

Kivo is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Game outcomes, matchmaking, and availability can vary.

Limitation of liability

To the fullest extent permitted by law, the operator of Kivo is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our aggregate liability for claims relating to Kivo is limited to the greater of amounts you paid to us for the service in the twelve months before the claim (if any) or fifty US dollars (or local equivalent), except where liability cannot be limited under applicable law.

Governing law

These Terms are governed by the laws that apply to the operator of the Kivo service. The operator’s legal entity and governing jurisdiction will be published when confirmed; until then, mandatory consumer protections in your country continue to apply where they cannot be waived.

Changes

We may update these Terms. The effective date will change when we do. If you continue to use Kivo after an update, you accept the revised Terms. If you do not agree, stop using the service and delete your account.
